Hi all
Firstly im not sure if I have posted this in the right section, I apologise if I have.
Basically I have no money to my name, maybe a few coppers laying about, but apart from that nothing.
I have no friends or family to turn to and certainly cannot afford or obtain a payday loan.
I have no food in the cupoards, and nothing I can sell to raise funds.
If anybody can suggest where to go/turn to I would greatly appreciate it.
I cannot get to and from work, lucky I have paid all my bills etc for the month
Regards

mobile contract & stuff

In 2011 I got a mobile phone contract and broadband dongle with Three on contact, 18 months for both. I was paying £49.99 a month until I lost my mobile phone, I phoned 3 and they cancelled my sim card.

I cancelled all direct debits (was living in supported accomadation at the time), moved back in with my mum in 2012.

Last month I recieved a bill of £1799.64 from 3 for the two contracts I had with them in 2011.

It seems as though they never terminated the contract and kept charging me a £50 monthly fee for 3 years even though I cancelled all direct debits.

Are they allowed to do that? Keep on charging me after cancelling all direct debits?

Hello all

I've just had my first letter back from sending off full and final settlement offers.

It's from KPR, for a Nationwide credit card. The card was in my wife's name.

I have debts of my own and we wanted to allocate a fixed figure to everything. That means, I included my wife's debts in the settlement calculations –!perhaps I shouldn't have done that.

If I understand correctly, because this is my wife's debt, I can offer some money for her (I have recently come by some money)?

Basically, I offered £2706 on a £6698.02 debt. KPR have come back saying they won't accept that but will accept £3349. Would it be feasible now to write to them / ring them to ask whether they would come nearer to the original offer? Any tips for achieving that?

Default notice vs bank charges ...

Hi everybody,

Please forgive me if this has been asked before, but I'm new and couldnt find the answer after a wee while searching.

Basically I want to know if there is any grounds to dispute a debt with a bank (unpaid overdraft on a now closed account) on the grounds that the debt is made up entirely of unfair bank charges they imposed on me?

The situation may be familiar to some, but unfortunately I've done my best (or worst) to completely stick my head in the sand for a few years,

Anyway, it goes like this: A few years ago, whilst a student, I ended up in a pretty horrific debt spiral with a high street bank.

I lived pretty close to my overdraft limit most of the time. One slip up led to some charges one month, which in turn knocked me past my limit for that month, and so the spiral continued. At the time, I complained to my bank and were not willing to talk about it at all. Their solution was to increase my overdraft ... and then to immedietly charge me 100's in fees which once again put me at the limit.

After having no job as a graduate for a few months the bank then closed my account without warning, I phoned them to complain, saying I'd been given no notice, and they simply said that I'd have to pay back my overdraft. I told them they owed me thousands in unfair fees and said that if they wanted the money they could take it out of that.

After all this, it went quiet for a long while. I moved house, got a job abroad, moved again.

Anyway, I'm now a responsible adult (aort of) and have checked my credit file and seen that I have a default for 2,800 againt me from said bank.

I know I've made several mistakes along the way, but I want to try and sort this out so ... I have a few questions / options that I would like some opinions on.

1 - Is it too late to try and reclaim these bank fees from them, which total over 3,000. If I reclaim that, I'm happy to pay them the money they claim I owe them and pocket the extra for myself.

2 - If I can't reclaim, or may have trouble reclaiming, is there any way to dispute the debt by arguing that the money they claim I owe them is from unfair bank fees?

3 - Since I only have 18(ish) months left before the default expires, am I best to just keep quiet and hope it all goes away after that? I know this way I cannot try to get and bank fees back, because as soon as I approach the bank they will come after me again for the money I owe them ... but quite honestly I already view it as their money.

Genuinely, for years I had thought they had wiped it off against my bank charges (perhaps too hopefully!).

Sorry for the long message. Trying to provide as much detail as possible.

Looking forward to opinions and answers,.

Stand-out value groceries

Hi folks,
I have just been reading an old thread about an OP with very little money for food and people made some great food suggestions. (Made me want to write them down but probably out of date now).

There were some stand out great items and I thought it would be good to have these in one place for people who use this board who have very little money for food or trying to cut back on their grocery spend. I'm thinking of things that are super cheap but taste good/ok.

E.g. someone mentioned Sainsburys basic curry sauce in the old thread as tasting nice (and it is only 30p)

Any ideas?

Things keep coming up:

I was tootling about these boards about four months or so ago. Because I'd like to get out of debt.

Yet I get focused, start saving to pay off a chunk - and then it goes elsewhere. It's driving me potty.

Both daughters are at Uni, so I have two lots of rent to 'help' this year, but once I started it seemed I had to pay it all, so I'm still about £3,500 short on that - and I feel I have to pay that 'off' first.

The car needs taxing this month and i didn't know.

My step son moved out last month so we gave him £500 for a deposit.

It seems like I never get to apply my spare money to what I want to.

Is it just me? I really am going month to month at the moment, but nothing I actually owe is going down.

Wednesday 13th Aug - What small DFW things will you be doing today?

When we start out on the DFW trail we do loads of "big stuff" that makes quite a difference to our situation. These include having our lightbulb moment, cutting up the credit cards and cancelling Sky and the gym .

But once we have done the bigger stuff, we often feel that we are not making the same amount of progress, when in fact the small steps are helping us form good financial habits and helping us get closer everyday to staying in control and becoming debt free, or staying debt free.

Examples could be hanging washing out instead of using the tumble dryer or leaving your purse/wallet at home to avoid the risk of spending .

So be proud of those small steps, they really are important. :money:

Cannot afford to pay all our bills, what are the options?

My financial situation has gotten worse of late. To follow up a previous post, I was dismissed from work in Sept last year. Since that time, my partner has found a full time job and I stay at home and look after our 15 month old son.

We are claiming child benefit, have recently applied for tax credits and are receiving housing benefit (£200 a fortnight). But with all this and her wages, it isn't enough to pay everything. we owe the following:

£800+ in arrears with the electricity company, with the neeed to pay £50 min a month.
£300+ arrears with the water company, with the need to pay £26 a month.
£40 a month for TV/Internet/Phone from Virgin
£30 a month for my mobile (contract ends in November)
£40 a month for my partners contract.
£40 a month for DFS sofa, 1 month arrears.
2 months bounced payments for council tax, now £240 owed.
£200 arrears for the rent. Been paying our £775 a month on time, only been short twice.
There is my partners £160 a month car on finance from Fiat, her insurance also, I forget the amount.

Everything is bouncing in my bank, I'm always in negative numbers or positive depressing amounts like +£0.54. We struggle to buy food for the family and it seems our son is the only thing holding us together.

I thought about going down the debt management road, offering token amounts, but I am unfamiliar with how this works and what they can accept.

Any advice on this would be great, allow me and my partner to sleep a little better at nights, which is difficult currently.

Should I Go Bankrupt??

I've been in bad debt since I was 19 years old and am now 27 and still in approx 30k of debt, never missed a payment and have a good credit history.
I have always planned to pay my debt properly (it was through my own stupidity and poor money management) and have so far cleared 15k through (up until recently) working 2 jobs 7 days a week and totalling 80-90 hours minimum, I have since given the job up as spending time with my 1yo son is a higher priority now. However after having some savings which have now all but gone I am verging on needing to go back to 2 jobs which would mean not seeing my son and still not having the money for quality time with him for atleast 7 years!!
TBH I'm at the end of my tether, I am sure I have paid the debt of atleast twice over due to interest and am now quite frankly not worried about my credit score as it is looking highly unlikely that I will ever be able to save the 25-30k deposit required to get a mortgage, life is for living right? and I am fed up of living a life with debt, the sleepless nights, the constant worry, the lying to my wife that everything is ok.
I have a company car so can't have that taken from me, we rent and I have about 1k savings so nothing that can really be taken from me, is it time to bite the bullet and think of the future, go bankrupt be done with it, suck up my pride and bring the dream of being debt free closer??
Any advice would be greatly appreciated

Can I send CCA request without it being with DCA?

Hi all, Hope ur all well?

My mum has a Barclaycard which she opened many many years ago. Because she's never defauled on a monthly payment its never gone to a Debt Collecting Agency - its still held with Barclaycard - even tho she hasnt used the card in years.

The balance is around 950. she pays the minimum a month, half of which is interest.

I was thinking of doing a CCA request for her - but is this wise?

I hate the thought of her struggling trying to meet minimum payments when they may not even have her orginal credit agreement.

The exact same situation my mother-in-law is in - same Barclaycard she's had for years she's been paying, with alot of interest etc etc.

What du advise peeps?

I've recently had a CCJ which I've been in touch with the creditor about (a major utility company) and reached a payment agreement which, if I keep up payments, I can apply to have the court costs removed. No problem.

I've just received a flyer-type-thingy from a company called MoneySave Solutions, detailing the CCJ reference, warning me about worst case scenarios and offering their negotiating services - which I don't need and have no intention of following up.They're also offering to help me claim back mis-sold PPIs (who isn't?).

I'm wondering where they got my details from, though. Do the courts make judgement information available to all so soon after the event? The judgement date was 1st August and this flyer/letter is dated 5th August. There is a little note at the bottom that says if I let them know then they'll take me off their mailing list. I didn't realise I was even on it!

And who is this company? All I can find out is that they operate on a franchise basis. And do I contact them to get my details removed and risk them never leaving me alone?

"Action at law" advice

$

Hello there,
It's taken us a while but we have all our debts arranged and despite some terrifying procedures managed to have the courts on our side who actually helped us from losing our home. Long story but thankfully sorted now. We've been carrying on ok for a few years now and unfortunately two companies rocked the boat a little and started to make more demands/threats. As a result they claimed the minimum payment was no longer sufficient and despite explaining others with even higher amounts to repay were accepting the situation which the courts and citizens advice helped us with they didn't want to know. In a strange turn of events they refused any further payments and so for the last two years have received nothing because "they couldn't accept such a low offer". So now in the last few weeks communication has ramped up again and we have a preliminary notice of legal proceedings and that an "action of law" will commence demanding all payment in full plus expenses.
I totally accept I owe them money but they have acted rather strangely and I'm thinking that this is either rather serious or some bizarre attempt to threaten us again. The debt hasn't been on my credit file ever and was taken out almost ten years ago. Can anyone advise me please?

Lowells and £30 claim

$

This must seem trivial, but here goes. Lowells are chasing this amount as a cancellation charge for a car policy. It was a mistake as a policy was cancelled and re-broked with the same underwriters although a different company.. Post Office and then M&S. I disputed the charge and was told if I sent back the old cert of insurance they would waive any charges. I did this but then got a claim for the £30 from a DCA called CARS. Eventually I spoke to the Post Office credit control who said the claim would be lifted. This was done and CARS closed their claim. However the underwriters have re issued this claim via Lowells. The question I have is that if the account was closed, can they now start again with Lowells ?

I have correspondence from Post Office first one saying no cancellation fee and then letter 2 saying there is.

Seems like Lowells are going to a lot of bother over this, and endless e mails asking for proof that the cert was sent back.

Any Ideas how I should proceed ? As alway any replies appreciated

Credit raiting Default help needed

Hi, I have two defaulted CC accounts, and I am paying them off. The default was in 2010 and I would like to know when the Default on my credit history will not be marked default any more? I understand this should be 6 years from the default but as i am still paying them off is it 6 years from the last and final settlement payment? I did ask MA, but they did not know and they advised i speak to debt charities but they did not kow either - any help would be most welcome. Sally:T

How Do I go about fixing this?!?!

So I added up all we owe - other than mortgage. and it comes to £15,898.76 roughly. Its around £618 a month in repayments, approx £278 of that is interest.

I did try to get a repayment loan to pay it all off but they said that "they didn't think that ALONGSIDE all the other borrowing we could afford it"

Selling the house will not solve it so that is not an option in any way shape or form.

I have looked and if we get a loan of 16000k over 4 years the interest could be around 4% and repayments of £361. £256 LESS than we pay at the moment. and would pay back £17,329.40 as opposed to £29,652 if we keep it as is. but our credit ratings are in teh 650-770 bracket.

I do not know how to convince the banks that I am trying to clear it all as obviously........they want us to keep paying them the interest don't they! Why make £17.5k when you can make nearly 30 k!?

I really do not know what to do. I could do an IVA but that will mean we cannot even have a mobile phone contract for 6 years and the car would poss be sold if deemed ot be over 5k.

I just don't know what to do... This year - until April 2015 its manageable as we get help with childcare. Next year we wont and so we will be in minus figures to the point of not even able to get to work.

I use Calendar Budget and I reconcile it every evening and we have halved our spending but still....need help.

Pro-rata offers in full and final settlement – confused!

$

As I am discussing on other threads, I have made some pro-rata offers in full and final settlement of my creditors.

However, I'm not sure I've done it correctly, as in one case the account is in my wife's name solely (whereas I thought it was joint) and in all cases I allocated a finite amount to every debt pro-rata rather than separating between her and me.

To top things off, I am confused about what to do with joint debts.

It will perhaps be best for me to list the debts and who they are for and then see what advice you can offer me / us.

Here they are:

akinika aka Halifax £7555 me
KPR aka Nationwide £6698 my wife
Mercers aka Barclaycard £10520 me
Metropolitan aka first direct £1981 me
Metropolitan aka first direct £1916 both
Santander £3647 my wife
total £32,311k :(

Please can someone suggest how to divide £10k fairly between these accounts?

Hi Folks,

After a difficult week of feeling sorry for myself and getting myself stressed over our 40K debt, I am now feeling a lot better!!! Thanks for all of the supportive comments that I received on my previous posts.

managed to secure 0% deals for our non 0% card debt. This will really help.

Just done some number crunching and we should pay off 17K by this time next year which will make a big difference to my stress levels!! It will also mean that we will pay less interest even if we can't secure further 0% deals in 12 months.

I don't know why but owing under 20K will be such a relief for me. I reckon we will reach that stage by Christmas 2015 with all of out debt cleared by December 2016. For me being totally debt free has never really been the main focus. My immediate goal is to get it to a more 'normal' level - I know that 'normal' is relative but owing 40K worries me even though we can afford the repayments.

Think I might post a SOA later to see if anyone can make any suggestions about how we can cut back a bit more.
