Drysden Fairfax - Erudio - Threatening to enforce CCJ Please help!

Hello everyone

From glancing at the site, I can see there has been a lot of discussion regarding Erudio/ Drysden Fairfax. However, I can't see any posts relating to my particular problem...forgive me if has been answered somewhere else!

Received a letter this morning, and has left me in a state of shock! Took out a student loan in 1994-1995. Very stupidly and naively ignored this debt and had a CCJ awarded against me in 2001. Have had no correspondence regarding this matter since and have managed my finances a lot better!

Letter states that a CCJ was awarded against me in 2001 and that Erudio want me to pay a debt of £1691. If not, they are threatening court action - AOE order/ Bailiffs etc.

What are my options here? Have I no option but to pay up? I am hoping to get a mortgage next year and worry that my now relatively-clean credit record will be ruined by this. If I start to pay them by instalments, will this show up on a credit search?

Hi all again!!

Thanks for the advice from the last post that I did believe me I am trying so hard to take it..but I just feel so guilty about just leaving Gregory Pennington and not paying them I have cancelled the direct debit and now on the online account section they have it says card payment due on 3/9/14 of. £264 please help I am lost and scared

Howdy
I've got an Experian credit check report and one of the entries is for my mortgage account which I defaulted on and subsequently the house was repossessed.The current entry for it says 'satisfied',does anyone if that means they may try and recover it somehow?The default balance is/was over £100,000...

i have just today recieved notification from dhss that i owe £13.000 from 14 years ago, i believed the debt was settled as i have not heard anything from them for 10years 2 months , what is my standing on this matter, they are demanding settlement by 30th august, and as i say i thought this matter was dealt with when i was with my ex-wife, please any advice or correct information my new wife is beside herself

Hi, this is my first post. I have had a few letters from Drydensfairfax solicitors which are causing me some concern. I have read this forum for other things in the past and I've been impressed by the expertise you guys have, so I'm hoping someone can provide me with some advice on what I should do next.
I received a letter from Drydensfairfax Solicitors last week asking me to contact them about an outstanding debt.
This was followed by another letter from a company called Erudio Student Loans saying they had instructed Drydensfairfax on their behalf.
Another letter landed today to explain they had records saying a CCJ was issued against me in 2001. They went on to say that they would like to make a suitable agreement with me, but should I not choose to agree payment with them they mayissue an attachment of earnings order against me, mayissue a warrant of control for a bailiff to attend my address to obtain goods or they mayapply to the court to obtain a Charging order over my home.
I am aware from reading this forum that DCA's can be conniving and will attempt to frighten and intimidate debtors into paying. Despite this, I am really worried about the letters which have suddenly started landing for a loan I took out in 1996. I didn't defer the debt and stupidly (conveniently) forgot about it as no correspondence ever came to me about it. Although I am now reasonably well paid (no more than that) I am not in a position to make any substantial payments to Drydensfairfax. From what I have read, the CCJ means I will not be statute barred, which leads me to believe I will have to pay the debt.
They have attached a declaration of earnings and outgoings forms, but I am reluctant to return anything without checking with someone with knowledge in this area first. However, my gut feeling is that I will need to acknowledge this letter as I do not want the situation to worsen.
I would really appreciate any advice from you guys on what to do next!

When we start out on the DFW trail we do loads of "big stuff" that makes quite a difference to our situation. These include having our lightbulb moment, cutting up the credit cards and cancelling Sky and the gym .

But once we have done the bigger stuff, we often feel that we are not making the same amount of progress, when in fact the small steps are helping us form good financial habits and helping us get closer everyday to staying in control and becoming debt free, or staying debt free.

Examples could be hanging washing out instead of using the tumble dryer or leaving your purse/wallet at home to avoid the risk of spending .

So be proud of those small steps, they really are important

* taking dgd to town to buy her some shoes - courtesy of db as a late birthday present :A
* pop into the pound shop & look for a lunchbag for dgd
* return library books & get a couple more
* Going to a friend's this afternoon & on to a party on the beach. Will stay until dgd starts to get tired
* do some housework!

hi I've been following the forum for some time for its useful help but am in need for of a little bit more.

I sent Fredrickson International a standard 'prove it' letter from this site which they received on the 9th august.

on the 13th august had another letter, this time from Bryan Carter Solicitors saying they were "to commence legal action and issue a claim"

just had another letter from Bryan Carters (16/8) dated the 15th August, it acknowledged the letter to Fredricksons but stated "It is the original creditors policy to provide agreements at the point of contract and statements throughout the duration of the account; consequently, you have previously been provided with validation of the debt and you are referred to your own records for the same.

"we and our client deny harassment and any such claim will be vigorously defended and you are to put to strict proof of such serious allegations."

im just stuck on what my next move should be as they haven't provided me with any evidence

Old Lloyds bank debt aggreement

Hi all, i'm have some questions regarding a debt agreement, i made a debt agreement with Lloyds bank a number of years ago (around 2002 roughly) to put all my loan debt with them into a 0% interest agreement and to pay a nominal amount back per month, this was after getting into financial trouble with them. Now it's 2014 i've got around £6000 left (estimated!) originally i think it was around £12k plus, i'm wondering:

1) Is there any time limits that they are allowed to made you pay the debt, eg after an agreement is made, after 5 yrs the debt has to be written off?? I think i read it somewhere thats all.

2) The debt doesn't show at all on any of my credit files, eg experian or equifax so does this mean in the eyes of the law it's dead?

3) As it's not on my credit file at the moment, if i made an offer of a full and final pay off, can they still add this to my credit file as a partially settled amount or as it's not on there will my credit file be left as is without being tarnished.

4) When claiming back my PPI for these loans, Lloyds said they couldn't find the original paperwork for some of these debts, therefore gave me an average payout amount for most of the loans. I've read online that if the company no longer has the original agreement paperwork they cannot enforce the debt and have no choice but to disregard the debt and has to write it all off.

Any help with these matters would be great, not trying to rip Lloyds off, but if i can get away with something because of a technicality, then it would serve them right for ripping me off all those years ago with an armed forces loan that couldn't of paid out PPI in any form whatsoever, because of my chosen armed forces career. So really they deserve it!

Creditor demanding my address

Hi everyone. I've got a few outstanding debts, and agreed to pay back my creditors in monthly installments. I've always paid on the 1st of each month and I have no plan to change this, as I want to clear off the debts.

I've moved about three times since last contacting some of my creditors. I want to get in touch with them to put forward a few full and final settlement offers. I am just worried that they will ask for my phone number, address etc. I had to change my sim a few years ago as there was a relentless stream of messages and telephone calls at all times of the day, even with the repayment agreements in place, and I don't want that to start again.

If they ask for my address, must I give them my current address, or can I refuse to give them my address? I'm happy to give my email address, and I want to pay back the debts, either by installments or as a full and final settlement.

Poor Credit Rating

Hello everyone :)

Usually lurk forums on occasion. Looking for some assistance this time round.

Long story short, after some poor decisions (mainly helping others) my own finances have got out of hand. I put no blame onto anyone else but myself for not realizing there is a limit to helpful one can be without impacting on themselves.

After Checking my credit rating i found it to be at 346 :lipsrseal

Current debt amounts to 10K and change.

Debts are manageable. Monthly payments etc. Some of the debt is over 2 credit cards, some on overdraft and remainder mum and step-dad (no rush / whenever).

Will be prioritizing credit cards followed by overdraft. Followed swiftly by mum and step dad.

My main reason for posting is for any guidance with improving credit rating?

Found that i am not on the electoral role within new home (6 months). Have already registered so this should go through shortly.

Payments are on time across any credit agreements.

Any Suggestions :p

DG Solicitors discounted settlement offer

Hi guys, I'm another newbie :cool:
I have a loan with HSBC which I defaulted in June 2009. I've been paying off the CCJ via 'DG Solicitors' for ages now- it was originally about £8000 and is now down to about £1500.

DG have been sending the odd letter for the last few years basically offering a settlement as a discounted rate. (The letters go to an old address and an ex kindly forwards them on.) This was always out of the question before, but I might be able to scrape something together finally, and I'm wondering how to go about, especially the wording of the letter and how to make sure the dirt is wiped from my credit file.

Any help very gratefully recieved:D

Today I reflected on the last 8 years , I took a further card out and by the the end of 2006 I owed 72000 entered a pay for dmp learned very quickly that all the rules laid do not apply when you in debt complain about your treatment told prove it had defaults threaten with court phoned 22 times a day from 8 in the morning to 9 at night thought things would improve never have today it dropped to be low 10000 what have I learned tesco use the police to threaten you at home with the pretence they had to send them round to check you are okay 1st credit what ever they say they mean the opposite Capitol one says we except your offer then an hour latter phoned and threaten court when you get fed up with there game tell them to do it then say you going to defend they except a 10 per cent full and final and last the ones that have taken the greatest pleasure in mental torture Mbna thank you for 8 years of pure hell you were pulled up by the oft told to improve but still do the same why no government body ever got the guts to deal with you I will never understand so 8 years on is it better well I owe under 10000 now still have not got a proper bank account can not have a contract phone looking at being credit blacklisted for life ( yes I know people on here tell you n such thing but the last year sure taught me there is) will the next 8 years be better i doubt it but thanks for the information on here it has made a small change

I am being chased for a debt from Lowell I have no knowledge of the debt and have sent a prove it letter the response I got from Lowell was the following to my astonishment !!
Dear xxxxxx
Thank you for your letter dated xxxxxx
We understand that you have no knowledge of this debt and request closure or proof of the debt or otherwise you will make a complaint to trading Standards and the FCA
This account relates to a xxxxxx credit card at xxxxx(address)
Due to the age of the account we are unable to evidence your liability and proof of the balance. Therefor we offer a discount of 15% in order to bring the matter to closure.
We understand that you may refer the matter as a complaint and therefore attach a copy of our complaints procedure.
We trust this clarifies the matter and look forward to hearing from you in the next 14 days.

How on earth can a company work and get away with this kind of practice !! they are admitting they cannot prove I owe the alleged debt however they are still asking for payment !!
Any advice as to what my next course of action should be against these incompetent muppets ?

Hello my name is Josh. First off I suppose a context and then what my debts are would be appropriate, so here goes.

In December 2013 it was suspected I had epilepsy this meant my agency employer couldn't find any work for me this meant I went from earning £400 AT to less than a £100 AT. I foolishly in hindsight used my credit cards and overdraft to stay afloat. By February I was nearly £3000 in debt. It was then discovered I didn't have epilepsy and could work again.

From then onwards I cut my outgoings down to a minimum no cinema cards, holidays e.t.c. I had to keep my phone contract which I negotiated down to £25 from £37 as well as storage costs of £20pcm as well as the costs of servicing my debt e.t.c.

I then moved into my now ex-partners flat which in hindsight was a bad decision, for legal reasons I can't discuss too much on this area other than I'd to leave for my own safety. This made me homeless and then I was put on sick leave due to anxiety & stress. So as the situation stands I have outstanding debts/contracts and no money to service them. I'd like to know the best course of action, please?

RBS Overdraft -£200, (Current Account, +57.50ish a week)
RBS Credit Card -£146 (Disputed/Card Destroyed), (Not Paying)
Natwest Credit Card -£80 (Card Destroyed), (Paying £20pcm)

It may also be relevant to mention I'm in Scotland.

Weekly Spend Challenge W/C 17 August 2014

Hello everyone. Welcome to the Weekly Spend Challenge. This challenge is open to anybody, no matter what financial place they are in. Everyone is welcome here.

On this thread please post an amount of money you wish to stay below within the week (Sunday to end of working day on Friday). This can be pennies or thousands it depends on the individual. Then next Saturday report back and pledge for the following week. The challenge runs from Sunday to Friday so we don't include Saturdays but feel free to change the rules to suit you and include Saturdays or start on a different day.

Feel free to update this thread with daily spends if that keeps you on track. We colour code the results as below:

Purple - zero spend
Orange - made money over the week

This is a little bit of fun but for many it highlights the fact that maybe that magazine/chocolate bar isn't needed. Hopefully your spending habits can be changed forever.

I took out car insurance with insure you motor. Everything went well,
I sent my documents to them that they requested to finalise the contract. Due to my job I had to leave the for a month, on my return I had a letter from them stating they did receive the documents and therefore canceled the contract. After which I had to pay a cancelation fee. The debt got passed to Daniel Silverman and since they have threatened me with court action

Where do I stand?
In my knowledge they received my documents, so in my eyes I for filled my end of the contract.

Definition of `Credit`

So if we were to purchase something online and the item returned to a company for a refund and they say yes return it and we will `credit` you.

Does that mean that your bank would be credited back the refund.
It now appears that the company is sitting on my money and saying I have a credit on their account to purchase something, and wont give me my money back.

This hinges on the definition of `credit` ?

Where to start to cut down and decrease debt?

Hi MSE's,

I am feeling very lost and confused as I have reached a point in my life where I don't know what to do financially. I have gone through life, gaining small amounts of debt on top of each other and without budgets and I am now in a position where I want to turn it all around but don't know where to start.

What budgets should i put in place? Or what debt should i get rid of first? Where to start?

Any advice or experience would be greatly appreciated.

Query with regards to the long distance selling regulations, which state then when an item is purchased that certain details including the cancellation policy should be provided in writing or by email. however... I quote........

Failure to provide this information by the trader will entitle you to a much longer period in which to cancel the order, as your right to cancel doesn’t end until 7 working days from the day after the seller does provide it. This is up to a maximum of 3 months and 7 working days from when you placed your order.


So if say this was not supplied in the order email or delivery email would then one have a right to a refund within a period of 3 months 7 days ?
